Deposition

Sworn out-of-court testimony taken by a notary, who administers the oath and may certify the transcript.

A deposition is sworn testimony given by a witness (deponent) outside of court, typically in connection with litigation. A notary public may administer the oath to the deponent, take the deposition, and execute a certificate to the deposition (Government Code §8205(a)(3)).

Statutory maximum fees for deposition-related services:
• Taking the deposition: $30
• Administering the oath to the witness: $7
• Certificate to the deposition: $7
• Maximum combined total: $44

The deponent must be positively identified and must take an oath or affirmation before testifying.

Exam Tip: The combined maximum fee for all three deposition services is $44 ($30 + $7 + $7). These are statutory amounts set by Government Code §8211(c). Do not confuse the $7 deposition oath fee with the $15 fee for administering a standalone oath or affirmation under §8211(b).
