Misdemeanor

Any crime other than a felony.

The New York booklet uses the traditional binary distinction: a misdemeanor is any crime other than a felony. In practical exam use, the point is usually not the bare definition but the consequences that follow from the crime level, including the maximum sentence under Penal Law §70.15.

For notary materials, misdemeanor classification appears often. Acting without appointment under Executive Law §135-a, certain official-misconduct situations under Penal Law §195.00, and unlawful practice of law consequences through related provisions can all bring misdemeanor treatment into the discussion.

Practical note: If felony is the heavier classification, misdemeanor is the lighter—but still criminal—one. The word should never be mistaken for a mere civil penalty or paperwork violation.
